Terms of service

These terms are an agreement between you and Winding AI Inc., doing business as Winding Labs ("Tumbly", "we", "us"), for using the Tumbly apps, the back-seat screen and tumbly.ai (the "Service"). Please read them with our privacy policy and Children's Privacy Notice.

1. Accounts are for grown-ups

You must be 18 or older (or the age of majority where you live) to create a Tumbly account, buy a subscription or accept these terms. You may create profiles for children in your care, you agree to these terms on their behalf, and you are responsible for how they use the Service. Keep your sign-in and optional parent PIN private, and tell us if you think someone else has access.

2. Driving safety

The driver must never look at, touch or talk to Tumbly while the car is moving. RoadStory is designed to run on its own once a trip starts. Set it up before you drive, mount any device so it doesn't block your view, keep the volume at a level where you can hear traffic and emergency vehicles, and let passengers handle screens and questions.

Follow all traffic laws and local rules about phones and screens in vehicles, including rules about screens visible to the driver. Stories describe real places for fun and learning. Don't rely on Tumbly for directions, road conditions, or safety information, and never stop or change your route because of a story. Supervising children in the car is always the adult's responsibility.

You can cancel any time, and it's as easy as signing up:

Cancellation stops future renewals. Your family keeps the paid features until the end of the period you've already paid for. Deleting the app or your Tumbly account does not cancel an App Store or Google Play subscription.

6. AI-generated content

Some stories, pictures, voices and answers in Tumbly are made with AI. We design it for kids: answers are short and filtered for age-appropriateness, stories are fact-checked against sources before they're published, and children can't chat freely with the AI. Even so, AI can be wrong, incomplete or unexpected. AI content is for entertainment and learning, not professional, medical, safety or navigation advice. Please listen along with your kids and report anything that seems wrong or inappropriate to support@tumbly.ai; we review every report. You can turn off live AI features in the grown-up area.

7. Acceptable use

Don't misuse the Service: no attempts to break, overload, scrape or reverse-engineer it, to get around limits or parent checks, to access other families' data or back-seat rooms, to make the AI produce harmful content, or to use it for anything unlawful. The Service is for your family's personal, non-commercial use.

8. Our content

Tumbly, RoadStory, our stories, art, voices and software belong to us or our licensors. We give you a personal, revocable, non-transferable license to use the Service for your family's non-commercial enjoyment while you follow these terms.

9. Disclaimers and limits of liability

The Service is provided "as is" and "as available." To the extent the law allows, we disclaim implied warranties, and we're not liable for indirect, incidental or consequential damages, or for anything that happens because someone used the Service while driving. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim (or $50 if you haven't paid). Some places don't allow these limits, so they may not apply to you, and nothing here limits rights you have under consumer law that can't be waived.

10. Ending use

You can stop using Tumbly and delete your account at any time. We may suspend or end access if you break these terms, with notice where reasonable. If we shut down a paid feature, we'll give prorated refunds for web purchases.

11. Changes, disputes and law

We may update these terms and will post changes here with a new date. For material changes we'll notify parents by email or in the app before they apply. California law governs these terms, except where your local consumer law says otherwise. Before filing a claim, please email hello@tumbly.ai so we can try to fix it.

12. App stores

If you got Tumbly from Apple's App Store, these terms are between you and us, not Apple. Apple isn't responsible for the app or its support, has no warranty obligation beyond refunding the purchase price under its policies, and is a third-party beneficiary of these terms. The same applies to Google Play.
